Let's suppose that a Trustee presents fabricated information to the Board, and it has been proven to be fabricated and untrue. The Trustees that voted might not been aware that there was fabrication. The result of the vote is to dismiss a member of staff who had not been subjected to any process, such as investigation/grievances etc.
In short, there is evidence to show that the staff was subjected to discrimination and victimisation due to ongoing whistleblowing and as a result of the act by this trustee, the staff lost their job.

- When it goes up for litigation, does the liability fall to the Charity? (this may include but not limited to discrimination, defamation, victimisation, detriment, whistleblowing)
- Is the Charity responsible for any outcomes of the legal processing and associated pay (eg for discrimination etc)?
- Even if the other Trustees oust the Trustee that created this situation, is the Charity still liable?
